These Terms and Conditions (“Terms”) govern your access to and use of the websites, landing pages, forms, advertisements, communications, products, services, and related platforms operated by Medley Insurance Agency (“Medley”, “Company”, “we”, “us”, or “our”).

Medley Insurance Agency operates as an independent insurance brokerage and a marketing, advertising, and lead generation company that connects consumers with licensed insurance agents, agencies, carriers, and service providers.

By accessing our website, submitting information through any form, requesting a quote, clicking advertisements, communicating with us, or otherwise using our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least eighteen (18) years old and a legal resident of the United States to use our website or services. By submitting information to us, you represent and warrant that:

3. TCPA and Communications Consent

By submitting your information through any form on our website, you expressly consent to receive marketing and informational communications from Medley Insurance Agency and our insurance and marketing partners, agents, affiliates, and service providers at the telephone number(s) and email address(es) you provided — including through the use of automatic telephone dialing systems, artificial or prerecorded voice messages, SMS/text messages, and emails — regarding insurance quotes, reviews, and related products and services.

Consent to receive such communications is not a condition of purchasing any goods or services. Standard message and data rates may apply. You may opt out of SMS messages at any time by replying STOP. You may opt out of marketing emails by clicking the unsubscribe link.

4. Lead Sharing

You acknowledge and agree that information you submit may be shared with one or more licensed insurance agents, agencies, carriers, lead buyers, marketing partners, and affiliates for the purpose of providing quotes, reviews, marketing, and related services. You may receive contact from multiple parties as a result.

5. Intellectual Property

All content, trademarks, logos, designs, layouts, copy, images, and source code are the property of Medley Insurance Agency or its licensors and are protected by US and international intellectual property law. You may not reproduce, distribute, or create derivative works without our prior written consent.

6. Disclaimer of Warranties

The website and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by law, Medley Insurance Agency and its officers, directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the website or services, even if advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Medley Insurance Agency and its officers, directors, employees, affiliates, and partners from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the website, your violation of these Terms, or your violation of any rights of another party.

9. Binding Arbitration and Class Action Waiver

Please read this section carefully — it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the website or services shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver. You and Medley Insurance Agency agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Jury Trial Waiver. You and Medley Insurance Agency waive any right to a jury trial.

Opt-Out. You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending written notice to hello@medleyinsurance.com.

10. Governing Law

These Terms are governed by the laws of the United States and the state in which Medley Insurance Agency is principally located, without regard to its conflict of laws provisions. Subject to the arbitration provisions above, exclusive jurisdiction and venue lie in the federal and state courts of that state.

11. Termination

We may suspend or terminate your access to the website and services at any time for any reason, with or without notice.

12. Changes to These Terms

We may update these Terms at any time. Material changes will be posted with a new Effective Date. Continued use of the website after changes constitutes acceptance of the updated Terms.
